Beverly Marsh claims to be a process server (and she might be if that is even her real name) as well as many other callers that use shady tactics to intimidate people. As stated above, no process server will contact you. They show up at your home unannounced. That is their leverage; the element of surprise. Also they will camp out in their car and do some surveillance to try and catch you off-guard. They did this to a relative of mine. Legitimate process servers are usually certified by the National Association of Professional Process Servers, insured and/or bonded by the state they reside/work in. However, each state has their own requirements. Some only require a competent adult to serve a process but these are generally divorce or domestic cases. I suggest anyone reading this to educate themselves so you know your legal rights. I am sure these debt collectors read up on this information in order to appear authentic. They assume most consumers are ignorant and use this ideation to their advantage. The Federal Trade Commission has a document called, "State by State Survey of Process Servers". Usually process servers work directly for a law firm, debt collection attorney who represents a real company, or some other legal entity like the sheriff's office, not a call center. Servers can work for a courier service but again the client utilizing this service is in most cases a law firm or attorney. There is an additional fee(s) depending on how many attempts they try to serve a process if not successful the first time. In my county the sheriff will serve you. If a server does show up, ask them for their credentials and ID to prove they are who they say they are. Anyone can claim to be something they are not. NEVER give out your personal information over the phone or otherwise. The one who is attempting to collect the debt should know all of this.
