Thank you for your post. These people called my Uncle today looking for me and scared him half to death. I told him not to worry about it. My only question is should I call them back.

Oh, one other thing to remember...if someone calls and says they are coming to serve you papers, that's another big red flag. Process servers DON'T call in advance to tell you they're coming to serve you legal papers - if they gave anyone advance notice of that, they'd never get any of their papers served. Make sense? So watch for that as well - any "collection agency" claiming that they are sending someone out to serve you papers is lying - they simply don't do that. If they're going to serve you papers, they're just going to show up.

Caller had a horrible connection, which made it difficult to hear what he was saying, but it was obvious he was reading from a script. He claimed to be from the "attorney services division" of a company (company name inaudible) and that they had "felony charges" against me in their office and wanted to give me the opportunity to discuss it with them before they sent out a locator service to serve me the papers. He mentioned "intent to defraud a financial institution" among the charges.

I suspect very strongly this has to do with payday loans, which I fell into the trap of using several years ago. However, I paid off ALL of my loans and never used them again, so he's barking up the wrong tree.

If you get a call from this company, do the following:

1) Demand they validate the debt in writing through the mail. If they balk at that or refuse to do so, hang up. That's your first red flag that they are not a legitimate company, but a scammer. If they ask for your address to serve the papers or send validation, tell them that if they are already in possession of a legitimate debt file, they should have it - make them tell you the address - don't give it to them.

2) If you legitimately owe a debt that these people are trying to collect on, tell them that you will deal with the original creditor - not a collection agency. You have the right to do so.

3) Another red flag - this company may attempt to threaten you and frighten you into paying a debt you do not owe. They will say they're coming to serve papers at your place of employment, that they're going to have you arrested on felony charges, etc. The important thing to remember is this: There is no debtors prison anymore. You cannot go to jail or be arrested for defaulting on a loan or not paying a debt. However...you *CAN* be taken to civil court if you don't pay your debts and the creditor decides to obtain a Warrant in Debt to garnish your wages. It's important to know the difference. This company is threatening felony charges and arrest on matters that are not felonies. They are counting on you being frightened enough by their words to pay something you may not legitimately owe.

Sorry for the long post, just hoping it will help someone else avoid paying these scammers.

The man with a broken english accent called threatening me that there is legal action being taken against me. That I needed to call back this number immediately. If problems call back in 50 minutes. Well after calling 40 times it says welcome and hangs up on me or rings or someone answers and hangs up on me. So I seen it was a cell number so I sent a text sayin I was sick of being hung up on that they can call me. This is the second call today that they have been threatening me like this. This is not fair and I wish I knew how I can take care of this legally or stop it. Last week they called my number over 50 times when I was in the hospital. Really is that necessary?

Yes they state that they are the FBI Fraud Investigations and if you don't pay them! They will get very unprofessional and get mad that you don't give them you debt card or credit card or checking account. They are a scam and say you owe a old payday loan or might not exist in my case. The company will threaten you and say there are coming to your house to arrest you," if you don't pay now"! And then state they are taking legal action against you, they will even give a bogus acct number that says it is filed in state you live at or by your states case numbers. They will even tell you broke the USA FDIC penal code(lie!!) the penal codes are usually three or more you might have broken(don't fall for the scam) and then it gets better: they will read your address and last four digits of your social. Well I did call the FBI and they inform me and, said call your local police department and tell the caller the number to your local FBI agent, or your local police Department. Do not pay them anything!! They are from a 3rd world country and want your info to fraud you. If they threaten be strong and don't let them tactic you in to paying. There collections tactics is illegal and unprofessional. The US does not allow these collection methods, do to our rights and laws. Be careful they will say there are agent office (what ever American name the make up)!! MR SMITH is one name, they use. Thought I would let you know. Run from the calls if you can't take the heat! And be careful they will call family members and tell them you are going to jail and they to contact you to keep you at of Jail.
